Anyone on here a solicitor?

Trying to build a case to complain about my awful NHS experience and repeated failures and mistakes by 'top' nhs surgeons.

I have spoken to a few no win no fee lawyers but I am over 3 years since the original surgery. My argument is that I am not a urologist or medical professional. How am I supposed to know this is wrong when I am being told that it is right by the surgeons. It was only this year that I had a correctly fit implant which means it was possible!

Any information would be really helpful or anyone willing to take on this case.

That's a terrible experience, I am sorry for you.
You should ask a relation to another "friendly" urologist doctor that can assess the errors

Then use a good lawyer and go ahead. Try to seek some lawyers that specializes in medical errors.
I would also tell who are this "top" surgoesn that operated you so others can avoid

BTW since you have had so many surgeries already and you are young I suggest you to go the malleable route. You have a good size so that will not be a problem

Thanks for the reply. Finding a good solicitor who is willing to take on the case and understand the penile implant seems to be the issue. Hence why I thought I'd reach out here. Also I don't know If anyone has successfully complained after the 3 year period.

It's going well! I'm under a month out still but I'm happy with the implant. It feels very natural and better than the titan. Also it reaches the glans and the pump is well positioned. He also showed me a video of where the titan tubing had split and told me it was easy to get the right length. There was no scar tissue like others had claimed.

Just a point to consider. Here in the USA. Many of the top malpractice attorneys have also received their medical degree. Medical cases can be so complicated that it really helps to have a lawyer that has a medical background.

I am not providing legal advice here, because I am not licensed where you live.

Sounds like the key to your problem could be what we call the Statute of Limitations here in the US. Many states have limitations of one, two or three years from the date of the procedure that caused the problem. After that date runs, there can be no malpractice claim (but the issue is often when the offending physician has ceased their professional relationship with you, and in some places it can matter when you knew or should have known about the problem). In the US, it's not just whether you had a bad outcome, but did the physician deviate substantially from the "standard of care" for your procedure. It's a very, very complicated issue and you will need to get the opinion of a very experienced malpractice Lawyer (Solicitor) who practices in the geographical area where you had the procedure done.

I handled plaintiffs' malpractice cases here in the US for 15 years. Very difficult work here.... If you have taken your case to several malpractice specialist lawyers and none of them think you have a viable case, then they are likely correct. A good case will make significant money for a lawyer, while a bad case will cost them thousands, if not tens of thousands of pounds/euros/dollars (sometimes hundreds of thousands). A good, experienced specialized malpractice lawyer will know if you have a good case right after they review your medical records, so please acquire them before you see a lawyer. High volume and nearly no volume are both bad characteristics for a malpractice lawyer.

In the US, there are many pitfalls to successfully pursue a claim, so please, only speak with people who specialize in that area of the law. The lawyer who practices primarily in criminal defense or family law will not know of the pitfalls and you could lose your case without really getting started.

Dr Ralph is one of the highest rated implanters there is what happened with him that wasn't right?

Dr Ralph is the surgeon I was going to choose if I went down this route, although it's probably hard to judge on this case since he was the 3rd surgery fixing a previous mistake so is probably not. A. Fair. Reflection on his own Surgery.

Thanks for your detailed reply. Yes 3 years I am statute barred. However my argument is how did I know? And even when I did sense something was not right I was told by top surgeons that's its all in my head and it's just how my anatomy is. Nothing they can do. When in fact that was not true and I only found that out this year with the 4th revision surgery. Therefore I only found out the surgery was wrong now when it has been completed successfully.
