The final result is 100% dependent on the doctor's call. I can tell you from experience that every surgeon uses the company representative differently; some take their advice seriously as part of their surgical team, while others see them just a part of the suppliers chain.

If pursuing a malpractice lawsuit individually (not a class-action one), and you have a good case, you will need to retain an "ambulance chaser" lawyer, not a big firm.
This is a delicate subject that due to the fact that some surgeons (at least I know of a couple of them) are active on this forum. If there would be a way on this forum to discuss and disseminate information about this subject, aside from PM function, I will be more than happy to provide you all options available for patients to hold the irresponsible surgeons accountable. Believe me, there are multiple ones. Not all are easy task, but possible.
