Could implant cause you not to get job/hired?

Postby coldbrew » Sun Jul 29, 2018 3:24 am

I have had a couple jobs where they did a thorough exam. No way they would not discover the implant, or at least the pump.
Also, you have to list all surgeries, and missed time at work.
How embarrassing this would make looking for a new job.
One place I had to sign a form to release medical records.

Dave, 80, Maryland - Implant (Titan) 2008 by Dr. Andrew Kramer (failed Sept 2020) - never used due to a stroke that, among other things, ended my sex life.

If you are in the states asking for medical history is illegal and you could potentially sue for lost wages if you are declined a job for medical reasons.

I hire people in my professional life and we aren’t even to ask how old a person is to avoid the perception of age discrimination if we had required disclosure. I would be surprised that a company would be so foolish to ask these questions as it would be easy for any lawyer to sue if you were turned down.

My company has a single person in HR that I had to inform for my short term disability application. If that person were to share the information I could sue for all my wages from now to my retirement date. Hippa laws are extremely strict about protecting medical information.

Yeah, I second David.

But it depends where you’re from.

That said, why would having an implant stop you from getting a job??

I cannot imagine that having an implant would in any way keep you from getting a job. I agree with others that if you could prove discrimination, then you would have a good lawsuit since it is illegal to discriminate against someone because of a medical condition .

What job asks for your surgical history ???? I would love to know the answer to that question: "what job asks for your surgery history"

I can foresee the possibility of an implant preventing you from getting a job but only if you were playing with it during the interview. :)

Pre-employment testing has gone out of control here in Missouri. With a republican super majority, pro employer, cut employee costs any way possible it is getting freaky. Drug tests have been standard here for a long while. Very hard for people to get a job w/o passing that. I know good hard working people who smoke a joint on the weekend and they are fired all the time due to the test. Add to that the pre-employment physicals and they are not just to see what medical liability might come up. Several attorney friends and I have discussed employers are using the drug screens and medical screens to deny workman's comp claims or to claim employee fault due to medical issues or meds if they are injured or cause an accident. A friend's sons foot was run over by an fellow employee this week. Both had to go to the emergency room. 1 for emergency surgery and a drug screen, the other for a drug screen to see if either employee could have been a contributing factor. Sitting in the waiting room for labs 4 months ago people were talking about being there to get CO2 blood and nicotine blood screens to keep their job ( prove they don't lie they don't smoke) or 1 who said to keep their employer health insurance and they were required to pay for their own screens at $80 a pop. This past week a friend had to do the same thing. Said he had to the the CO2 blood screen @ $37 each 4 times over 3 months to keep his job. It is nuts but with for profit healthcare insanely priced as well as for profit insurance also insanely high, I can understand trying to keep healthcare related costs down. Back to the implant, there has been a lot of talk lately that having E.D. is a precurser and side effect of high blood pressure, stroke, heart issues, kidney issues and such. Precaution has turned into a freak show. I've friends who are store managers at large chain stores. In our conversations they have told me that once I listed my health issues and meds there is no way H.R. would ever pass me on to management for an interview but they do hire a couple disabled (walk with a hitch) or some such persons so they cannot say they discriminate. Sucks but the way it is. Health issues = time off for doctors, illness, med costs, insurance costs, possible job injuries. I've advised how to have a safe work environment for 30 years and our youngest daughter wrote safety manuals for large corporations. Neither of us mention medical histories but in today's world, I am unemployable. The current political climate says so fucking what to that. It used to be all we had to worry about was being over 40 to keep a job. Freaky cost and liability world.

There are exceptions to EEOC laws, especially in all transportation related fields and some areas medical related. I have to maintain an annual D.O.T. physical plus a medical exam every 3 months for monitoring of health issues. In the medical arena, I am required to report I have a communicable disease even though I maintain a state that I cannot infect anyone nor would any procedure create a risk. That said, my infection is specifically listed in the ADA.

Anytime someone injures another party with a vehicle there is an evaluation to discover whether drugs/alcohol were a contributing factor. This is true whether on the job or on a public street. Considering there are well over 100 billion in damages and over 10 thousand people killed due to alcohol alone I doubt anyone considers that inappropriate. There is also the assumption that one or both parties contributed in some way to a vehicle accident unless there is some highly unlikely vehicle equipment failure. This, however, is pretty far removed from a discussion on whether a penile implant can have an impact on employability.

i have no expertise in employment law. I do have opinions regarding "high performance high reliability professions" and the best example of that would be a pilot of a commercial airplane. Those guys are given pretty strict physicals and I guess do get checked out pretty often.

So, considering the airplane pilot example, I can understand if there was an eye disease, then maybe you might get bounced from the job, or perhaps if you had a tremor which precludes you from accurately quickly pushing cockpit buttons, then yes, perhaps OK. In contrast, the penile implant just sits inside you, sort of like a hip joint replacement, and will have no bearing on just about any job I can imagine. Certainly, the strictest job with hundreds of lives at stake (airplane pilot) can be done with no issue at all in the presence of an implanted penis.

I suppose if you are a porn star, then the implant might be discussed at the job interview, but likely will be considered a plus since filming can be continued with 100% reliability for hours on end.

The only thing that makes a bionic male different from a non-implant male is that the bionic will have great sexual confidence around women --- if that disqualifies a male from a particular work environment, then likely we would not want that job !

Brothers --- can you imagine a scenario where your surgiery history needs to be disclosed ? It is private personal info -- yes ???
